1. Acceptance of Terms

By accessing and using GentleMail ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service.

2. Service Description

GentleMail is a paid anonymous message relay service that allows registered users to send confidential messages to recipients via email. All messages are subject to AI-powered content moderation before delivery. The Service provides complete sender anonymity to recipients, though sender information is logged internally for security and compliance purposes.

3. User Registration and Account Security

You must register an account to use the Service. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized account access
  • Be responsible for all activities under your account
  • Be at least 18 years of age or the age of majority in your jurisdiction

4. Credits and Payment Terms

  • Cost: Each outbound message costs 1 credit. Receiving replies is free.
  • Payment: Credits are purchased through Stripe payment processing. All transactions are secure and encrypted.
  • Non-Refundable: All credit purchases are final and non-refundable, including credits for rejected messages.
  • No Expiration: Purchased credits do not expire and remain in your account indefinitely.
  • Pricing: Current pricing is displayed at checkout and may be updated at our discretion with notice.

5. Content Moderation and Message Rejection

All messages are automatically screened using AI content moderation before delivery. Messages will be rejected without refund if they contain:

  • Harassment, threats, intimidation, or violence
  • Hate speech, discrimination, or targeted attacks
  • Sexual content, exploitation, or adult material
  • Illegal activities or promotion of illegal goods/services
  • Spam, phishing, or fraudulent content
  • Self-harm or suicide-related content
  • Any content violating our Prohibited Uses policy

Content moderation decisions are final. Rejected messages will be logged and repeated violations may result in account suspension.

6. Rate Limits and Usage Restrictions

To prevent abuse, the following limits apply:

  • Maximum 3 messages per day per user
  • Maximum 1 message per recipient per day
  • 30-minute cooldown period between message sends
  • Rate limits reset at midnight UTC

7. Prohibited Uses

You expressly agree NOT to use GentleMail for:

  • Harassment, stalking, threats, or intimidation of any person
  • Spam, bulk messaging, or unsolicited commercial communications
  • Illegal activities, fraud, money laundering, or criminal conduct
  • Impersonation, identity theft, or misrepresentation
  • Distribution of malware, viruses, or malicious code
  • Child exploitation, abuse, or endangerment in any form
  • Violation of any local, state, federal, or international laws
  • Circumventing rate limits, security measures, or content filters
  • Accessing or attempting to access another user's account
  • Reverse engineering, decompiling, or extracting the Service's code

8. Privacy and Data Collection

We collect and store the following information:

  • Account Data: Name, email address, registration date
  • Technical Data: IP address, user agent, browser information
  • Message Metadata: Sender ID, recipient email, subject line, timestamps, moderation results
  • Message Content: Temporarily stored for moderation and delivery; not permanently archived after successful delivery
  • Payment Information: Processed by Stripe; we store transaction IDs but not credit card details

9. Anonymous Sending and Reply System

  • Recipients cannot see your name, email address, or any identifying information
  • Messages appear to come from a randomized reply address (reply+TOKEN@gentlemail.io)
  • Recipients can reply to your messages; replies are delivered to your account inbox
  • Your anonymity is maintained throughout reply threads
  • We log sender information internally for security and legal compliance

10. Account Termination

We reserve the right to suspend or terminate your account immediately, without notice, for:

  • Violation of these Terms and Conditions
  • Repeated message rejections due to policy violations
  • Abusive, fraudulent, or illegal behavior
  • Chargebacks or payment disputes
  • Any conduct we deem harmful to the Service or other users

Upon termination, unused credits are forfeited without refund.

11. Intellectual Property Rights

  • All Service content, trademarks, logos, and technology are owned by GentleMail or its licensors
  • You retain ownership of your message content
  • You grant us a limited license to process, moderate, and deliver your messages
  • You may not reproduce, distribute, or create derivative works from the Service

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of uninterrupted, secure, or error-free operation
  • Accuracy or completeness of content moderation
  • Delivery of all messages to recipients
  • Protection from third-party actions or legal consequences

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENTLEMAIL SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, punitive, or special damages
  • Loss of profits, data, reputation, or business opportunities
  • Damages resulting from message delivery failure or delays
  • Damages from content moderation errors or system outages
  • Any damages exceeding the amount you paid for the Service in the past 12 months

14. Indemnification

You agree to indemnify, defend, and hold harmless GentleMail, its officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms and Conditions
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations
  • Content of your messages

15. Dispute Resolution and Arbitration

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Arbitration Agreement: Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration shall take place in Delaware. You waive any right to a jury trial or class action lawsuit.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or violations of prohibited uses.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, internet outages, government actions, natural disasters, or third-party service provider failures.

17. Severability and Waiver

  • If any provision is found unenforceable, it shall be modified to the minimum extent necessary, and remaining provisions shall remain in full force
  • Our failure to enforce any right does not constitute a waiver of that right

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email to your registered address at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of updated Terms. You may terminate your account if you disagree with modifications.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GentleMail regarding the Service and supersede all prior agreements, communications, and proposals.
